Van's TV Terms of Use

Welcome to Van's TV.

These Terms of Use ("Terms") govern access to and use of the Van's TV streaming application, website, and related services (collectively, the "Service"), operated by Van's Media Company LLC ("Van's Media Company," "we," "our," or "us").

By accessing or using Van's TV, you agree to these Terms. If you do not agree, please discontinue use of the Service.

1. About Van's TV

Van's TV is a digital streaming platform that provides access to video content, commercials, promotional materials, informational programming, graphics, and other media from participating businesses and organizations.

The Service allows viewers to browse available channels, select individual media items, and use playback features such as continuous looping, shuffle mode, and media controls.

Content may be updated, added, modified, or removed without requiring viewers to update the application.

2. Eligibility and Access

Van's TV is intended for users who are legally permitted to access the Service in their jurisdiction.

The Service is currently available without a paid subscription or mandatory viewer account.

Certain features, media, or channels may become subject to additional requirements in the future.

We reserve the right to modify, restrict, suspend, or discontinue access to any portion of the Service when reasonably necessary.

3. Acceptable Use

You agree to use Van's TV lawfully and in accordance with these Terms.

You may not:

• Attempt to gain unauthorized access to Van's TV servers, systems, or administrative functions.

• Interfere with application performance, streaming delivery, or network infrastructure.

• Circumvent technological security or access restrictions.

• Reproduce, redistribute, modify, or commercially exploit content without appropriate authorization.

• Use automated systems to scrape, extract, or excessively download content without permission.

• Use the Service in a manner that violates applicable laws or the rights of others.

We may restrict access when we reasonably believe these Terms have been violated.

4. Content Ownership

Videos, images, graphics, logos, audio recordings, trademarks, and other materials displayed through Van's TV may be owned by Van's Media Company LLC, participating businesses, organizations, independent creators, or other third-party rights holders.

All applicable copyrights, trademarks, and intellectual property rights remain with their respective owners.

Access to content through Van's TV does not transfer ownership or grant permission to reproduce, redistribute, sell, or otherwise exploit that content.

You receive a limited, nonexclusive, revocable permission to access and view content through the Service, subject to applicable law and third-party platform terms.

5. Content Submitted by Participating Organizations

Organizations authorized to manage Van's TV channels may provide videos, graphics, advertisements, and other media for distribution through the platform.

By submitting or authorizing content for publication, the submitting organization represents that it:

• Owns the content or possesses sufficient rights to distribute it.

• Has secured any necessary music, image, video, talent, trademark, and other applicable permissions.

• Has obtained appropriate consent for identifiable individuals appearing in submitted materials.

• Will not knowingly submit unlawful, misleading, defamatory, or infringing content.

• Accepts responsibility for claims, promotions, and other statements contained in its materials.

Participating organizations retain ownership of their original content.

They grant Van's Media Company LLC a nonexclusive, worldwide, royalty-free license, for the period that the content is authorized for distribution and any reasonable technical wind-down period, to host, reproduce, encode, adapt for technical compatibility, transmit, publicly display, and otherwise distribute that content through Van's TV and its supporting delivery infrastructure.

Additional business agreements may govern content licensing, production services, publication schedules, and other commercial arrangements.

6. Promotional and Advertising Content

Van's TV may display commercials, advertisements, promotional offers, announcements, or sponsored programming supplied by participating businesses and organizations.

Such content may promote products, services, events, or other commercial activities.

Unless expressly stated otherwise, promotional claims, prices, availability, warranties, and offers are the responsibility of the organization providing the content.

The presence of a business or promotion on Van's TV does not constitute a guarantee, endorsement, or warranty by Van's Media Company LLC.

Offers and promotions may be subject to separate terms established by the participating organization.

Van's TV is not affiliated with or endorsed by Roku, Dropbox, or DigitalOcean.

7. Content Availability

We aim to maintain reliable streaming access, but we do not guarantee uninterrupted or error-free operation.

Playback may be affected by internet connectivity, hardware limitations, third-party infrastructure, maintenance, content processing, or temporary technical problems.

Channels and media libraries may change at any time.

We may remove or restrict content to address copyright concerns, legal obligations, inappropriate material, technical requirements, or violations of these Terms.

We are not obligated to preserve the availability of any particular channel, video, or media item indefinitely.

8. Third-Party Platforms

Van's TV relies on third-party services, including Roku, Dropbox, and DigitalOcean.

Your use of those services may also be subject to the applicable third-party terms and policies.

Van's Media Company LLC is not responsible for outages, interruptions, policy changes, or service restrictions imposed by independent third-party providers, except as required by applicable law.

Use of Van's TV on Roku devices remains subject to applicable Roku platform requirements and terms.

9. Public and Commercial Display

Van's TV may contain programming intended by participating organizations for promotional or informational display.

However, availability through Van's TV does not independently grant public-performance rights, commercial exhibition rights, or permission to operate a Roku device contrary to applicable platform terms.

Organizations using Van's TV in dealerships, stores, offices, showrooms, or other commercial environments are responsible for confirming that their equipment usage and content exhibition comply with applicable licenses, laws, and platform requirements.

10. Fees and Payments

Van's TV is currently free for viewers to download and access.

Participating organizations may separately purchase production, marketing, channel-management, or related services from Van's Media Company LLC under individual business agreements.

Any future paid viewer functionality will be governed by applicable additional terms and platform payment requirements.

11. Privacy

Your use of Van's TV is also governed by our Privacy Policy, which describes how certain technical information, playback preferences, and service-related data may be handled.

Please review the Van's TV Privacy Policy before using the Service.

12. Disclaimer of Warranties

To the extent permitted by applicable law, Van's TV is provided on an "as available" and "as is" basis.

We do not make warranties concerning uninterrupted availability, compatibility with every device, the accuracy of third-party promotional content, or the suitability of the Service for a particular purpose.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Van's Media Company LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the Service.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

14. Copyright and Content Complaints

We respect intellectual property rights and will review credible reports of content infringement.

If you believe material available through Van's TV infringes your rights, please contact us with:

• Identification of the allegedly infringing material.

• Identification of the rights you believe have been violated.

• The channel or media location involved.

• Your contact information.

• A description of your ownership or authorization to act on behalf of the rights holder.

We may request additional information and take appropriate action, including disabling access to disputed material, consistent with applicable law.

15. Changes to the Service or Terms

We may modify the Service or update these Terms from time to time.

Updated Terms will be published with a revised effective date.

Continued use of Van's TV after changes become effective constitutes acceptance of the updated Terms where permitted by applicable law.

16. Governing Law

These Terms are governed by the applicable laws of the State of Indiana, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.
